Introduction

Welcome to Ooh.com. The following User Agreement applies to the website http://www.ooh.com and all subdomains therein, for users registering on or after 1st September 2009. By using the services provided on http://www.ooh.com you the user are hereby agreeing to the following terms. The Ooh.com User Agreement constitutes a legally binding agreement between you and Ooh.com, and unless you and Ooh.com agree otherwise, you will not be able to cancel this Agreement under the Consumer Protection (Distance Selling) Regulations 2000 (or any equivalent legislation in your jurisdiction) once the supply of the services has commenced.

General

Ooh.com is a platform and community where users may buy and sell activities and experiences, with a complimentary booking, feedback and messaging system. We encourage users to share and try new and exciting things to do.

Ooh.com does not charge a fee to list an activity or experience, nor does it charge a commission on sales of activities or experiences.

Use

You may not:

• fail to deliver payment for items purchased by you, unless an acceptable buyer cancellation has been made;
• fail to deliver a listed activity or experience sold by you, unless an acceptable seller cancellation has been made;
• manipulate the content or price of a purchased experience or activity such that the item is materially distinct from what was originally purchased;
• attempt to deliberately mislead other users in buying or selling;
• tamper with or falsify feedback ratings;
• change without prior consent the details of a listing or personal details of another user;
• distribute or post unsolicited email or spam;
• use the services Ooh.com provides in a way which is unrelated to Ooh.com or circumvents the listing and booking process; and
• copy, modify, or distribute Ooh.com's copyrights, trademarks, content, services or tools

Please note that the above list is neither exhaustive nor restrictive. Ooh.com reserves the right to suspend any user deemed to be in breach of any provision or the general principles and values of the Ooh.com community at any time.

Ooh.com encourages its community to be vigilant of prohibited or inappropriate behaviour, and report these via the relevant channels.

Content

You may not:

• post, list or upload content or items in an inappropriate category;
• post, list or upload content or items that are false or misleading;
• post, list or upload content or items that infringe the copyright, trade mark or other rights of third parties;
• post, list or upload content or items that are offensive or defamatory;
• list items that are illegal in nature or may result in illegal activity;
• list items that provide activities or experiences that do not exist outside of the internet¹; and
• post, list or upload content or items that are adult in nature

Please note that the above list is neither exhaustive nor restrictive. Ooh.com reserves the right to delete any listing deemed to be in breach of any legal provision or the general principles and values of the Ooh.com community at any time and without prior warning.

Ooh.com encourages its community to be vigilant of prohibited or inappropriate listings or content, and report these via the relevant channels.

Cancellation

A cancellation is deemed to be acceptable by mutual agreement of buyer and seller. Due to the varied nature of the activities and experiences listed on Ooh.com, it is impractical to suppose that standard terms for cancellation periods, retainers and reimbursements may be imposed on all activities. We encourage sellers to be as clear as possible from the outset about the particulars of their listed items in their own Terms and Conditions, and prompt and accurate communication between parties should ensure avoidance of doubt.

Liability

Ooh.com is not responsible in any way for non-delivery of items or non-payment for items and accepts no liability for loss of earnings, materials or reputation in the course of providing the platform and community. Ooh.com is intended as an environment that facilitates buying and selling only. It may not be vicariously held accountable for any errors or omissions in good or bad faith on the part of its users. The users of Ooh.com accept full liability for any errors or omissions made in the course of buying and selling.

Privacy

Ooh.com takes individual privacy seriously, and will not share your personal or business information with any third parties. Users are expressly prohibited from harvesting or collecting user details for marketing purposes other than those directly concerned with listed items on Ooh.com.

Breach of Agreement

Breaches of these policies may result in, but are not limited to, the following:

• Listing cancellation
• Limits on account privileges
• Account suspension

Third party rights

A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this User Agreement.
